Smith Corp.<\/em>, 521 U.S. 179 (1997), which clarified and delineated the accrual rule applicable to civil RICO claims.<\/span><\/li>\n<li><span style=\"color: #000000;\">Defeated defendant\u2019s motion to stay client\u2019s RICO claim on the basis of the parties\u2019 arbitration agreement:\u00a0 <em>Simitar Entertainment, Inc. v. Silva Entertainment, Inc.<\/em>, 44 F. Supp.2d 986 (D. Minn. 1999).<\/span><\/li>\n<li><span style=\"color: #000000;\">Obtained dismissal of a claim against a title insurance company based upon a riparian rights owner\u2019s inability to develop a marine due to environmental concerns:\u00a0 <em>R.W. Docks &amp; Slips v. Chicago Title Ins. Co.<\/em>, 2001 WL 856431 (Minn. Ct. App. 2001).<\/span><\/li>\n<li><span style=\"color: #000000;\">Defeated class certification and obtained summary judgment on behalf of the Mall of America, who had been sued by foreign-born taxi-cab drivers claiming discrimination:\u00a0 <em>Gold Star Taxi &amp; Transp. Serv. v. Mall of America Co.<\/em>, 987 F. Supp. 741 (D. Minn. 1997).<\/span><\/li>\n<li><span style=\"color: #000000;\">Obtained the dismissal of a claim brought by a Minnesota company against its former Japanese business partner on the bases that personal jurisdiction was lacking in Minnesota and the doctrine of forum non conveniens:\u00a0 <em>Fluoroware, Inc. v. Dainichi Shoji, K.K.<\/em>, 999 F. Supp. 1265 (D. Minn. 1997).<\/span><\/li>\n<li><span style=\"color: #000000;\">Was responsible for defending Rollerblade against product liability actions brought in the eastern United States: <em>see, e.g., Achatz v. Rollerblade, Inc.<\/em>, 642 N.Y.S.2d 250 (N.Y. App. Div. 1996).<\/span><\/li>\n<\/ul>\n<p><strong>Associate<\/strong>, <span style=\"color: #000000;\">Jones, Day, Reavis &amp; Pogue, Washington, D.C. (1990 to 1993).<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Was one of the principal authors of a federal trustee\u2019s 300+ page RICO complaint seeking to hold liable the principals of Bank of Credit and Commerce International (\u201cBCCI\u201d) for the losses incurred when First American Bank was seized by federal regulators after the collapse of BCCI; the complaint alleged that BCCI secretly acquired First American through regulatory fraud orchestrated by former Secretary of Defense Clark Clifford and his law partner, Robert Altman. The BCCI litigation was widely reported in the media and resulted in several court decisions.\u00a0 <em>See e.g.,<\/em> <em>Hamid v.
